British Columbia ‘Code of Professional Responsibility’
Object and Purpose
- Residential Tenancy Arbitrators are committed to fostering and maintaining a high standard of professional responsibility.
- This Code of Professional Responsibility ("Code") recognizes the fundamental responsibility to maintain the integrity, competence and effectiveness of the arbitration process.
- This Code provides guidance to arbitrators on matters touching their professional duties and conduct with a view to enhancing public confidence in the integrity, competence and effectiveness of the arbitration process and the rendering of decisions in accordance with the relevant law and procedure.
Application
- This Code applies to an arbitrator who has been appointed pursuant to the provisions of the Residential Tenancy Act ("Arbitrator").
Integrity, Impartiality, Objectivity and Independence
- An Arbitrator must not be influenced by partisan interest, political influence, public opinion, or fear of criticism.
- An Arbitrator must conduct hearings in accordance with the rules of administrative fairness and natural justice.
- An Arbitrator must not publicize any information acquired during the arbitration process.
- An Arbitrator must be and must appear to be impartial and objective at all times in respect of the parties and the matters before the Arbitrator.
- An Arbitrator must not make public statements which would call into question any Arbitrator's impartiality or objectivity.
Conflict of Interest
- An Arbitrator must disclose any interest or relationship likely to affect impartiality or which might reasonably create an appearance of partiality or bias.
- An Arbitrator must not hear any matter in which the Arbitrator has a conflict of interest.
- An Arbitrator must not hear a matter in which the Arbitrator has an apparent conflict of interest without disclosing the conflict to the parties and obtaining their consent to proceed.
Adoption and Changes to the Code
- All Arbitrators must be given an opportunity to vote on the adoption of, or changes to, this Code.
